News just in that judges at the appeal court in South Africa have decided on whether to overturn the culpable homicide verdict against Oscar Pistorius and find him guilty of murder for killing Reeva Steenkamp. Judge Leach has determined that principles of dolus eventualis were incorrectly applied and that the initial trial court failed to correctly deal with evidence.
Bottom line…Oscar has been found guilty of murder and the case will be sent back to the high court for new sentencing.
“The Supreme Court of Appeal has ruled that Oscar Pistorius should have foreseen the deadly impact his four bullets would have in a small bathroom.
“He fired four shots through the door and he never offered an acceptable explanation… he fired not one, but four shots… that is exactly what the accused did,” said Justice Eric Leach.
“I have no doubt that in firing the fatal shots, the accused… did foresee that whoever was behind that toilet door might die.”
He is guilty of murder and the matter is referred back to trial court to decide sentencing.” [Mail & Guardian]

“This morning, the Supreme Court of Appeal in Bloemfontein overturned Pistorius’ initial conviction and essentially charged him with murder for killing his model girlfriend, Reeva Steenkamp.
In a fairly brief judgment by Judge Eric Leach, Pistorius was found to have been indirectly murderous in his actions by firing four shots onto a closed bathroom door when not knowing who or if anyone was behind it.” [IOL]
